PUBLIC ORGANIZATIONS AS ELEMENTS OF THE MECHANISM FOR PROTECTION OF THE RIGHTS OF CONSUMERS

Abstract

The main models of the organization of consumer rights protection are described depending on the dominance in the system of protection of the rights of consumers of such entities influence, as bodies of state power, bodies of local self-government and NGOs. It is noted that the level of consumer rights in Ukraine is not meets the requirements that are being put forward to Ukraine on the way of integration into the European Union. The experience of foreign countries (USA, European Union countries) regarding the role of public organizations in the mechanism of consumer rights protection is analyzed. The activities of the most numerous and influential non-governmental consumer protection organizations in the USA – the National Consumer League (NCL); Consumer Union of the United States of America (founded in 1936, from 2016 – Consumer Reports or CR); American Consumer Federation (CFA). In Europe, public consumer organizations have a national and supranational nature (at the EU level, it is the Consultative Group of European consumers). The main types of consumer organizations existing in the developed countries are distinguished: 1) fully independent non-governmental organizations, most of which were founded in the middle of the 20th century. and are non-profit organizations (the most influential are magazines in the UK, the Netherlands, France, Belgium, Italy, Spain and Portugal); 2) institutions and organizations supported by the government (mostly in Austria, Germany, France and Denmark); 3) government consumer organizations (Sweden, Norway, Germany, United Kingdom). The main areas of activity – consumer policy, magazines with test results, consulting centers, consumer education, ombudsmen services are parts of the government structure. Recommendations for further development of the mentioned activity in Ukraine are formulated taking into account the positive long-term experience of foreign countries.
