SKETCH OF LEGAL POLICY IN THE SPHERE OF INSOLVENCY AND BANKRUPTCY

Abstract
The article is devoted to problems of formation of effective legal policy of the state in the field of insolvency and bankruptcy. The author thoroughly researched the existing theoretical basis of the research cycles of the national economy and the expediency of the relationship between economic cycle and the state economic policy. On the basis given in the article examples from the activities of large companies found that in many cases artificially created by the state conditions for their support not only to restore economic balance, and strengthen the crisis phenomena in national economy, resulting in a conflict between the state (public)and private interests (the interests of enterprises). In the article special attention to the development of the conceptual foundations of legal regulation of insolvency and bankruptcy inUkraine.
