SOCIAL INSURANCE AGAINST INDUSTRIAL ACCIDENTS AND OCCUPATIONAL DISEASES: TRENDS OF LEGAL REGULATION DEVELOPMENT

Abstract
Problem setting. The high level of occupational injuries in Ukraine requires the identification of priority areas for improving the legal regulation of employees’ protection against industrial accidents and occupational diseases. Analysis of recent researches and publications. The issues of legal regulation of social insurance against industrial accidents and occupational diseases were the subject of attention in the works of such scholars: M. I. Bodnaruk, O. O. Gavrilova, D. M. Kravtsova, O. L. Kuchma, O. V. Moskalenko , S. M. Prilipko, O. V. Solovyova, N. M. Khutoryan, G. I. Chanysheva, A. M. Yaroshenko. Article’s main body. In the article, based on the analysis of international legal acts, national legislation and scientific researches of the leading experts of the ILO on the issues of protection against industrial accidents, trends of the development of legal regulation of social insurance against industrial accidents and occupational diseases have been considered. The attention has been paid on the trends of creation the preventive insurance programs against industrial accidents and occupational diseases. The separate directions of realization of preventive maintenance in the system of social insurance against industrial accident have been considered, namely: measures of regulation; economic incentives of the employer depending on the state of work safety; cooperation with employees’ organizations, councils of labor collectives or labor protection committees established by social partners; expert advice; awareness of employees about harmful production factors and risks at workplace. It is noted that within the framework of preventive work on industrial accidents it is necessary to talk about improvement of legislation in the field of labor protection, especially in the case of tripartite interaction between government, employers and trade unions. Safe working conditions can be achieved only through a permanent social dialogue between the social partners and the acceptance by them respective obligations with its subsequent fulfillment. Protection from stress in the workplace, as a result of the impact of psychosocial factors in the production environment also should be taken ti the trends in the development of legal regulation. Also, the issue of simplifying the procedure for implementing the right to provide the social and medical services in the system of social insurance against industrial accident has been analyzed in this article. Conclusions and prospects for the development. We should concude about the necessity of providing a preventive system of social insurance against industrial accident, protecting employees from psychosocial risks in the production environment and simplifying administrative procedures.
