SOME ASPECTS OF INSURANCE IN THE CONTEXT OF INTELLECTUAL PROPERTY RIGHTS PROTECTION

Abstract
Some aspects of insurance within the context of intellectual property rights protection have been studied in this article. Since the right to defense is an element of the legal powers included in the content of any subjective civil law and the inviolability of intellectual property rights is guaranteed, so it is necessary to consider the legal mechanism of protection in the framework of its reinforcement. The article addresses the issue of impact of insurance exactly on reinforcement of protection of intellectual property rights. Thus, by using the insurance of intellectual property right an owner upon the breach of the corresponding right may en gage all resources of insurance company to fight with a violator and moreover count on the coverage by the insurance company of the incurred damages pursuant to the insurance terms regardless of the property position of the violator.
