SOME ASPECTS OF LEGAL REGULATION OF RELATION IN SPHERE OF LAND RECLAMATION IN UKRAINE AND CONFORMITY WITH EU REQUIREMENTS

Abstract
The article is determined that the conduct of reclamation in case of deterioration of qualitative characteristics of the soil can also be seen as the responsibility of the landholder. If a land user does not carry out actions to improve, restore the quality characteristics of the soil, the remediation can be carried out by a court decision where the claimant is appropriate council, but the current Ukrainian legislation does not sufficiently clearly define the criteria, upon the occurrence of which the relevant Council has the right to demand, and land users are obliged to implement reclamation of land. Such criteria may be established in the Procedure for conducting agrochemical passports field land, approved by Order of the Ministry of Agrarian Policy and Food of Ukraine of 11.10.2011 № 536.
