SOURCES OF MODERN ADMINISTRATIVE LAW: PROBLEMS OF UNDERSTANDING AND WAYS TO SOLVE THEM

Abstract
Ukraine is a young independent state. It tends to get into the European Union, and to become truly democratic, legal and social state. Human rights are priority in this country. In this regard, civil society is developing rapidly, and its life is changing. Ukrainian legislation is being changed because our government is seeking to make it acguis communautaire (EU legislation). Therefore the sources of new administrative law must be determined. Nowadays there is still a disagreement between scientists about modern system of sources of administrative law of Ukraine. Article is devoted to the nature and content of «source of administrative law». The analysis of different views on the modern system of sources of administrative law is studied. It was paid attention in this issue to such scholars as, Averyanov, Bevzenko, Bytyak, Kolpakov, Kurylo, Melnik. Each of whom brings their own vision of the vision of this system. The special attention is paid to a category «source of soviet administrative law», the point of view of modern administrative scientists and soviet scientists on this category is analyzed, its kinds, system and hierarchical construction. System of administrative law sources is built, it is represented by the decisions of party, Constitution and laws, international agreements and legal acts of management. The existing legal system and ideas of research workers concerning the possibility and expedience of acceptance the acts of judicial bodies and ordinary right as sources of soviet administrative law are researched.
