Stosowanie zasad ogólnych postępowania administracyjnego w administracyjnym postępowaniu egzekucyjnym

Abstract
The subject of research in this paper are the rules of administrative procedures that apply in enforcement proceedings in administration. Applying the principles of administrative proceedings we must take into consideration that enforcement proceedings is very specific. This means that only some of the administrative procedures can be transposed to the enforcement proceedings in the same terms like in the Code of Administrative Proceedings. Analysis of the general principles of administrative and enforcement procedures lead to the conclusion that they are not only characteristics of the guidelines left without the sanction process. It should be kept in mind that the principles stated in the Code of Administrative Proceedings are not only demands of science or not just recommendations. They constitute the legal norms. Establish a legal framework for operation of applying the rules stated in the Code of Administrative Proceedings. Their assessment is carried out by parties to the proceedings and administrative courts with the legal effect as a breach of any provision of substantive law. (original abstract)
