SYSTEMATICAL APPROVAL IN THE LEGAL POSITION OF THE PARTIES AND TERMS OF THE SETTLEMENT AGREEMENT IN CIVIL CASE

Abstract
The article deals with the settlement agreement in the context of negotiation processes. The existing concepts of sci- entists and foreign experience regarding the highlighted problem are analyzed. Considered actual court practice in family affairs, in cases where the subject of the dispute is a mortgage, and so on. Critical-constructive analysis of certain norms of the legislation, which regulates the issues, gives an opportunity to abusing procedural rights and proposes its own version of these norms.
