THE CONSTITUTIONAL PRINCIPLE OF CHURCH-STATE COOPERATION IN THE CONTEXT OF THE INTERPRETATION OF THE PRINCIPLES OF THE RESPECT FOR HUMAN DIGNITY AND THE COMMON GOOD

Abstract
The article presents the concept of the constitutional principle of cooperation between the state and churches and religious denominations in the context of the interpretation of two notions closely related to this principle: “the individual good” and “the common good.” The discussion is limited to the relationship between the state and the Catholic Church. The first part of the article describes three different interpretations of the principle of Church-State cooperation, which exist in the current doctrine of ecclesiastical law. The second part presents some fundamental differences between the Catholic social doctrine and the legal doctrine in the interpretation of the relevant notions of human dignity and the common good. By way of conclusion, it is indicated that the identical interpretation of the objective scope of the principle of Church-State cooperation by both parties is rather unattainable. As a result, one ought to recognize the necessity to mutually acknowledge the boundaries of this interpretation and to create a climate of dialogue, which remains the only way of agreeing on the scope of cooperation between the state and the Church.
