THE FORMATION OF THE PARLAMENT IN UKRAINE IN THE 1990s: HISTORICAL AND LEGAL ASPECT

Abstract
In the article the author analyzes the peculiarities of the formation of the Ukrainian Parliament in the 90s of the 20th century on the basis of the detailed analysis of the various sources. The author defines the transformation algorithm of the composition and structure of the national Parliament during the 1990s in order to generalize experience and its use while solving the present-day problems in the implementation of the Parliamentary reform in Ukraine. The author shows the constant transformations of the political and legal bases in the structure of the Verkhovna Rada of Ukraine. The author exposes the problems of the political struggle, forming the Parliamentary majority and as the result the emergence of the opposition and certain difficulties connected with it. So for a long time the guarantees of the opposition existence have not been legally ensured, its inner and Parliamentary relationships have not been regulated etc. While doing the research the author also defines that those who wished to be professionally engaged in politics appeared to be fewer than expected. Managers of different economic and enterprise structures became the most active in this sphere. Moreover the author characterizes the main criteria of the political structure of the legislative power body, the decision on establishing fractions and groups and the beginning of the process of deputies’ transference from one fraction to the other one. The author proves that during the first decade of independence organizational and political bases of forming the structure of the Verkhovna Rada of Ukraine changed three times. First, after the announcement of the sovereignty the Parliament began its constant work. This determined the formation of the constant profile committees and fractions. The Presidium of the Verkhovna Rada still existed and its Speaker had the right to sign adopted acts and regulations. Second, after the adoption of the Constitution of Ukraine the Presidium of the Verkhovna Rada of Ukraine was abolished. The role of the Speaker of the Parliament and his Vice- Chairmen became more important. The rights and functions of committees expanded. Every national deputy is to work in a certain profile committee. Third, more numerous fractions and deputies’ groups were formed as a result of transition from majority to mixed (majority and mixed) election system of national deputies to the Verkhovna Rada of Ukraine.
