The genesis of human rights as prerequisites of the rule of law: neoinstinctual approach

Abstract

The article examines the anthropological origins and nature of human rights, as well as derivatives of the phenomena of power and State in their relationship with the natural human rights and interests. Concluded that genetically inherent nature of fundamental human rights, and their satisfaction with primary function is defined by the rule of law. The State and power serve as a social mechanism for equitable distribution of human resources and social reproduction of society. Neoinstinctual approach to understanding power as a mechanism for sorting and distribution of values gives clear answers to such questions. Thus, elders individualized power seems primarily as ownership and capacity to manage these essential resources of life, the wisdom of generations, historical experience, the ability to forecast revenues and allocate time primary resources of life – values-things. Personified power of a charismatic leader is extremely scarce possession of spiritual values, aims, in particular, hope and faith in the "bright future" confidence to overcome any adversity. Institutionalized government elected (appointed, inheritance, etc.) is provided officials it available to the public the value of instruments - laws, rules, regulations, opening wide access to primary values-things. The same authority shall mean the presence of its carrier and tool of spiritual values that are impossible or extremely difficult to get much of society. The state as a political institution in its origins has instinctively caused Institute of Human Rights and built on its system of values that crucially affect not only the formation of state institutions, but also on its structural and functional building, the type of political regime, especially the power relations etc. The need for the orderly distribution of resources is an important feature of life biogenesis Earth – harmonious existence of wildlife. A slight breach of «fairness» of this distribution may lead to the extinction of entire species of flora and fauna cardinal same offense to cause global catastrophe biosphere. The «wild» conditions this function is performed by natural selection. In a politically organized society core values of social justice not only makes the institutionalization of government and state, but also creates a societal function normalization and equitable (in terms of the dominant sectors of society) allocation of scarce resources, values as rational-legal mechanism of realization of natural rights. And the more the state is based on the Institute of Human Rights, the more it becomes legal and signs of a democratic state.
