THE LEGAL PROTECTION OF EXHIBITS FROM ABROAD ON LOAN FOR TEMPORARY EXHIBITIONS - THE FIRST ATTEMPT AT REGULATION IN POLISH LAW. A VOICE IN THE DISCUSSION

Abstract
The article examines the current attempt at introducing into the Polish legal system a legal instrument protecting against the risk of claims connected with exhibits from abroad on loan for the purpose of displaying them at exhibitions and consisting of granting them temporary protection prior to the application of measures of legal coercion (jurisdictional immunity). The article brings the reader closer to the history of this institution in the world and goes on to consider the establishment in 2012 by the National Institute of Museology and Collections Protection of a team of experts, whose task involves, i.a. preparing reports concerning proposed solutions as regards the legal protection of museum exhibits on loan from abroad and projects of suitable legislation acts. The author describes the range of the work performed by the team and presents in detail the premises of the protection system suggested by the experts: the statutory premises upon which such protection depends and the effects of protection within civil, administrative and penal law. Subsequently, the reader is offered information about further work relating to the project, which resulted in changes introduced by, i.a. the Ministry of Justice and affecting the project of the premises prepared by the team. At present, the version of the Ministry project is the object of further government legislation. While discussing the Ministry of Justice project the author critically assessed the mechanism of the emergence of protection (at odds with the one suggested by the team of exerts). The solution accepted in the Ministry project leads to the exclusion of the possibility of undertaking legal steps even in relation to an exhibit that does not meet statutory conditions of protection. Consequently, A. Barbasiewicz expressed his anxiety concerning the project’s concurrence with the Constitution of the Republic of Poland and international law.
