The prescription for drugs: legal essence.

Abstract
The author analyzes the role and importance prescription for drugs in the health care system in Ukraine in the article. Analysis of the current legislation has revealed that the procedure used for dispensing prescription drugs poorly regulated, especially in law. It was also found specific features recipe and the basic tasks and functions that implement it by using various stakeholders relations. The prescription’s components does not allow it to the private law document or to individual acts of state administration. The author argues that the recipe is a legal document mixed, public-administrative nature, such as the administrative agreement. There is an important role of the technical component of the recipe. The study author suggests a definition of “prescription for drugs” and insists on the need to consolidate the regulatory definition of such determination.
