THE PRINCIPLE OF NON-DISCRIMINATION AS A BASIS FOR AD MINISTRA TIVE AND LEGA L PROCEDUR ES TO DETERMINE THE WINNER OF A PUBLIC PROCUR EMENT

Abstract
The article comparative legal analysis of the legislation of Ukraine and the EU public procurement on the procedure for determining the winner of public procurement. Based on this analysis conducted logical relationship terms «non-discriminatory requirements», «qualifying criteria», «requirements in the tender documents». The article includes an example of the definition of «discrimination in public procurement». The article presents proposals to improve legislation on the principle of non-discrimination during the procedure of public procurement. Also consider the possibility of restrictions winner selection criteria.
