THE PROBLEMS OF THE RECOGNATION INSTITUTION IN THE INTERNATIONAL LAW

Abstract
In the article the author views the problem of the ineffectiveness of legal mechanisms for the state and state-like entities recognition. Many scientists were involved in the problems of the Institute of state recognition, such as: Mr. N. Aleksandrov, Mr. M. Lazarev, Mr. V. Lisovsky, Mr. G. Hanum, Mr. S. Alekseev, Mr. M. Kolerov, Mr. A. Bolshakov, Mr. V. Dyvak, Mr. M. Rozumny, Mr. E. Berg , Mr. P. Colosto, Mr. D. Lynch. Unrecognized or partly recognized states by the international community, their functioning, development and place in the international system is one of the most painful and complex issues of the world toda y. The author defines two theories of recognition: declarative and constitutive. The Institute for the Recognition of New States, being one of the most important institutes of international law throughout the century, is still not codified. The main international legal material for use is the rules of international customary law and universally recognized principles of international law.
