Abstract
The article examines the issue about insurance the rights of individuals to freely choose a representative in the correlation of fixing in Constitution of Ukraine Bar monopoly to represent the person in court or in criminal proceedings. Constitution of Ukraine and practice of the Constitutional Court of Ukraine was analyzed to determine whether the content and narrowing of the constitutional rights of man and citizen were limited. Were made the conclusions about the need to expand cases in which a person who is not a lawyer can represent the interests of individual in court and the need to simplify procedures for becoming a lawyer.
