THE RIGHT TO ORGANIZE LESSONS OF RELIGION IN KINDERGARTENS AND PUBLIC SCHOOLS AND PRINCIPLE OF EQUALITY OF RELIGIOUS DENOMINATIONS

Abstract
Religious denominations of regulated legal situation have a right to organize lessons of religion in kindergartens and public schools. The abovementioned right of religious denominations is confirmed by the right of parents to raise their children according to their own conceptions of religious character. Furthermore the fulfillment of the right of religious denominations to organize lessons of religion in public schools must be compliant with the constitutional principle of equality of religious denominations. In ecclesiastical law jurisprudence there are many charges raised against the conformity of legal solutions concerning the manner, in which lessons of religion are organized by the religious denominations in public schools with the principle of equality of religious denominations. These are as follows: description of the teacher of lessons of religion, description of religious education programs as a school subject, the limit of students necessary to organize lessons of religion and the right to release students attending in lessons of religion in order to participate in Lenten retreat. The principle of equality of religious denominations is pursuant to the jurisdiction of the Polish Constitutional Tribunal the exemplification of the principle of equality. Pursuant to guidelines of Polish Constitutional Tribunal the principle of equality means the equal treatment of similar entities characterized by the same particular relevant feature, which are in the similar situation. After analysis of particular legal solutions related to the right of religious denominations to organize lessons of religion in public schools from their compliance with the principle of equality of religious denominations point of view it should be stated that this constitutional principle is not being restricted in relation to fulfillment of the right.
