THE ROLE OF THE PROSECUTOR’S PARTICIPATION IN CIVIL CASES

Abstract

In a judicial process, the prosecutor has an active role in finding out the truth and complying with legal provisions. The prosecutor is a natural person with a public dignity function who can participate in civil cases (even if he is compelled to participate) when the offenses were committed by minors or incapacitated persons. The prosecutor’s participation in the civil process is based on the indissoluble link between the general interests and the personal interests of the citizens. Its presence is also an effective guarantee of respect for the subjective rights of natural and legal persons.
