Uwzględnianie wymagań związanych z ochroną środowiska przy projektowaniu i realizowaniu inwestycji drogowych

Abstract
Th e article presents and, as far as possible, discusses the provisions of the Polish law aimed at securing the needs of the living elements of the human environment in the design and implementation of road investments. Its purpose is not to present the technical aspects of the road construction process set by the applicable legal norms, but to show, how to ensure the principle of sustainable development in relation to the surrounding environment (flora and fauna) is guaranteed, which in a longer, not always perceived, dimension, is as important as satisfying the current needs of the users, and more important than the people’s comfort. The additional task is to guide why the human environment is so important to the human. After presenting the initial issues – the legal bases and terminology contained in them – the author goes over to discuss the environmental requirements and procedures applicable to the construction of roads, taking into account the practical aspect – by using a concrete example. The general conclusions are preceded by a reference to the subject matter of the passages for animals. Artykuł przedstawia i w miarę możliwości omawia przepisy polskiego prawa, które mają na celu zabezpieczenie potrzeb żywych elementów środowiska ludzkiego podczas projektowana i realizowania inwestycji drogowych. Jego celem nie jest zatem przedstawienie aspektów technicznych procesu budowy drogi, wyznaczonych obowiązującymi normami prawnymi, ale tego, jak w jego ramach ma zostać zagwarantowana realizacja zasady zrównoważonego rozwoju w odniesieniu do otaczającego drogę środowiska (flory i fauny), które w dłuższej, nie zawsze dostrzeganej perspektywie, jest przecież równie ważne, jak zaspokojenie bieżących potrzeb użytkowników, a na pewno ważniejsze niż osiągany kosztem otoczenia komfort. Zadaniem dodatkowym jest przypomnienie, dlaczego środowisko naturalne człowieka jest dla niego tak ważne. Po przedstawieniu kwestii wstępnych – podstaw prawnych i zawartej w nich terminologii, autor przechodzi do omówienia wymagań i procedur środowiskowych obowiązujących przy budowie dróg, uwzględniając przy tym aspekt praktyczny, czyli operując konkretnym przykładem. Ogólne wnioski poprzedza odniesienie do istotnej dla tematu kwestii przejść dla zwierząt.
