VECTORS OF IDEOLOGICAL CHANGES IN MODERN LABOR LAW

Journal Title: «Приватне та публічне право» - Year 2017, Vol 3, Issue

Abstract

The article is devoted to the definition of vectors of ideological changes in modern labor law. The urgency of the topic of research is determined by the fact that in recent years the question of the need to revise the ideological foundations of labor law has risen more and more as the current Soviet labor legislation lays down an outdated Soviet ideology that no longer meets the requirements of the present, with the absence of a well-developed system of ideological views for further development. labor law causes certain difficulties and in the adoption of mutually agreed new legal norms in the territory of our state. This question has already been thoroughly considered in our joint work with VI Shcherbina “Ideological Foundations of Modern Labor Law” in 2016 [1]. At the same time, the problem remains relevant, and time raises new challenges and raises new issues, the solution of which part we have to offer in this scientific research. In addition, the author’s monographic research did not directly raise the question of the definition of vectors in which the ideology of labor law changes, since the monograph is essentially the basic fundamental justification for the need to focus on the formation of a new ideological system of modern labor law and the disclosure of modern ideological principles of labor law. Consequently, the purpose of scientific research is to determine the vectors of “change” in the ideology of modern labor law. Achievement of the set goal is possible by solving the following tasks: to reveal the essence of the concept of “ideology of labor law”; determine the role of ideology in the formation of labor law; to establish vectors in which the ideological foundations of modern labor law should take place or should take place. The role and essence of ideological changes are revealed, the influence of social ideology on the formation of labor-legal norms is established. It is emphasized on the necessity of changes to work, to employees, to the parties to labor relations, to the principles of legal regulation of labor relations.
