ЗАКЛИК ДО ПРОТИПРАВНИХ ДІЙ: ЛІНГВІСТИЧНА ДІАГНОСТИКА ДЕЛІКТУ

Abstract
The paper addresses the issue of the theoretical and methodological background of the forensic linguistic investigation of a variety of verbal manifestations of illegal activities committed partially or entirely by means of using language, in particular performing certain speech acts. Representative examples are appeals and incitement to terrorist acts and various kinds of violence, appeals for the change of the state borders, propaganda of war and interethnic interracial, and religious hostility etc. The pragmatics of the speech acts, of the texts of media publications, of all kinds of pamphlets, posters etc is determined by performativeness of the language units, i. e. their ability not only to describe certain actions, but to verbally incorporate certain actions represented by the corresponding performative units. Concrete performative meanings are perceived against the background of the more generalized performative invariant represented by the genre of the text or particular speech act. Competent linguistic diagnosis of language crime requires the application of a sophisticated set of formalized methods acceptable for jurisprudence cognitive models.
