Zapis na sąd polubowny z udziałem konsumenta – uwagi na tle regulacji z art. 1164[1] KPC – część II

Abstract
Zgodnie z treścią nowego art. 1164[1] § 1 zd. 1 KPC, zapis na sąd polubowny obejmujący spory wynikające z umów, których stroną jest konsument, może być sporządzony tylko po powstaniu sporu i wymaga zachowania formy pisemnej. Regulacja z art. 11641 § 1 zd. 2 KPC stanowi z kolei, że w takiej sytuacji przepisu art. 1162 § 2 KPC nie stosuje się. Artykuł 11641 § 1 KPC odpowiada w swej treści brzmieniu art. 1164 KPC, odnoszącemu się do zapisu na sąd polubowny dotyczącego sporów z zakresu prawa pracy. W związku z tym, dokonując analizy art. 11641 § 1 KPC warto nawiązać do wykładni regulacji z art. 1164 KPC.
