ЗАЩИТА КОНСТИТУЦИОННЫМ СУДОМ РФ ЭКОНОМИЧЕСКОГО ПОРЯДКА

Abstract
The article analyzes the most resonant cases of the Constitutional Court of Russia related to the protection of economic order and social justice. The main purpose of the article is to illustrate the effective judicial practice in the conditions of unstable economic order and deep socio – economic stratification of the society. The author reworked and selected court decisions that demonstrate the increasing constitutional impact on economic relations, strengthening the role of constitutional control on the formation of economic order, on the “socialization” of legislation. Conclusions are drawn on the importance of the practice of the Constitutional Court of Russia to maintain an optimal balance of private and public values, a fair balance of interests of the individual, society and the state, certainty and predictability of legal regulation, maintaining a high level of mutual trust between economic entities. The article is of interest to researchers of constitutional justice, the positions of the Constitutional Court, its impact on legislation and law enforcement practice.
