APPLICATION OF LEGAL ANALOGY IN THE EXERCISE OF JUDICIAL DISCRETION IN CRIMINAL PROCESS

Abstract
The essence of the legal analogy and the analogy of law for the purposes of exercising the discretionary powers of the courting criminal proceedings is defined. Conditions that exclude the application of legal norms by analogy in criminal proceedings are clarified. The practice of the Supreme Court on the application of legal norms by analogy is analyzed.
