Abstract
The article reveals essential characteristics of a communicative conception of punishment of English legal philosopher А. Duff as а part of the formation of criminal penal system of liberal-democratic society. Special attention is drawn to theoretical conclusions of the scientist in the course of philosophical-legal reflection of the processes of transporting important legal provisions are the subjects of criminal process. Discovered a place of moral and ethical problems in the process of determining the nature of systems of punishment in the development of a democratic socio-political system.
