COMPARATIVE ANALYSIS OF COMBATING CORRUPTION IN THE EUROPEAN UNION

Abstract

This article is a comparative legal analysis of anti-corruption activities in Ukraine and Germany, studied methods and techniques combating corruption, conclusions about the need to ensure real public control over the activities of civil servants. One of the global problems whose solution depends on the further development of Ukraine in the new century is the problem of corruption. According to the ranking of corruption in the world by the international organization Transparency International in 2010, Germany in 178 countries of the world is in 15th place, but Ukraine is only one hundred and fifty fourth position. Fighting corruption – topical theme not only for Ukraine but also for other countries. In Ukraine, as in Germany, there are special laws to combat corruption, which outlined the main provisions of combating corruption policy. Aim of this paper is to conduct a comparative study of comparative legal anti-corruption activities in Ukraine and Germany, the allocation of common and distinctive features of its formation and development, the compilation of administrative and legal means to combat corruption used in the countries surveyed. The study of the problem of corruption in Germany showed that the main problem of the German legislation is that it lacks a clear definition of the phenomenon of corruption. In particular, the German law of 13 August 1997 “On Combating Corruption” are mainly provisions for amendments to the legislation, there is no actual definition of corruption or bribery. However, in Ukraine and Germany created special bodies, civil society organizations, but significant progress in the fight against corruption can not yet reach. The priority direction of the fight against corruption in our country must be prevention, which in modern terms requires a systematic approach, that of the realization of political, economic, psychological, legal and organizational measures intended to eliminate, minimize, neutralize criminogenic factors that give rise to a disruptive phenomenon.
