Abstract

As the practice of law enforcement shows, the differentiation of procedural form is a necessary thing. Even its opponents admit that in a single criminal trial there may be procedures that differ according to the degree of complexity of the procedural forms. In this respect, M. Strogovici, for example, has been criticized by several authors that although he pleads for unity in the process, he admits at the same time the existence of procedural differences on certain causes. The essence of the problem here is not that those opting for the unity of the procedural form contradict each other. It is obvious that they consider that some differences can be established in the procedural form without altering their unity, ie in other words without considering that the procedural form has been differentiated.
