ইফকের ঘটনা ও যিনার অপবাদের শাস্তি : প্রচলিত ও ইসলামী আইনের দৃষ্টিতে তুলনামূলক পর্যালোচনা|The Story of Ifk and Punishment for Slander: A Comparative Penological Discussion

Abstract
Aisha R. was the third wife of the last messenger of Allah Muhammad and the eldest daughter of the first caliph Abu Bakr R. she had been abhorrently slandered by the hypocrite circle. The holy Quran mentions the fabricated story in which head of hypocrites ‘Abdullah B. Ubaiy had slandered the intact sanctity of her sacred personality. As these Quranic verses sanctify concreteness of her superb character and affirm her sanctity, they also cite severe criminal punishment for those who had not returned to the truth by repentance. This paper in adopting exegeses and criminological methods, reviews the verses which had been revealed in certifying the sanctity of Aisha R. and offers a comparative penological discussion regarding the crime of slander while giving special concern to the supremacy of Islamic criminology. By reviewing the existing penal practices, this paper shows that the conventional criminal justice system has not offered any severe criminal punishmentg. In contrast, Islamic legislation gives a definitive punishment yet commensurate with the consequences of this. ‘আয়িশাহ রা. ছিলেন রাসূলুল্লাহ সা.-এর তৃতীয় স্ত্রী এবং ইসলামের প্রথম খালীফা আবূ বকর রা. -এর কন্যা। মুনাফিক সরদার ‘আব্দুল্লাহ ইব্ন উবাইয়ের নেতৃত্বে ‘আয়িশাহ রা. -এর পুতঃপবিত্র ও মহিমাময় চরিত্রের ওপর যে মিথ্যা অপবাদ রটনা করেছিল তার বর্ণনা তুলে ধরা হয়েছে আল-কুরআনে। এ সকল আয়াতে যেমনিভাবে ‘আয়িশা রা. -এর সতীত্ব, পবিত্রতা ও অনুপম চরিত্রের প্রশংসার প্রতি ইঙ্গিত করা হয়েছে, তেমনিভাবে যারা এ ষড়যন্ত্রে এবং মিথ্যা অপবাদে অংশ নিয়েছিল কিন্তু পরে খাটি তাওবাহ করে ফিরে আসেনি তাদের কঠিন ও ভয়াবহ শাস্তির বর্ণনা দেয়া হয়েছে। আলোচ্য প্রবন্ধে ইফকের ঘটনাকে কেন্দ্র করে নাযিলকৃত আয়াতসমূহের ওপর একটি পর্যালোচনাপূর্বক প্রচলিত ও ইসলামী আইনে যিনার অপবাদ দেয়ার শাস্তি সম্পর্কে আলোচনা পেশ করা হবে। বর্ণনামূলক ধারায় আলোচিত এ প্রবন্ধ থেকে প্রমাণিত হয়েছে, প্রচলিত আইনে অপবাদের শাস্তি সুস্পষ্টভাবে পৃথক কোন আইন বা আইনের কোন ধারায় বর্ণিত হয়নি, বরং মানহানী সংশ্লিষ্ট বিভিন্ন আইনের আওতায় এর শাস্তি নির্ধারিত হয়। পক্ষান্তরে ইসলামী আইনে কুরআন-সুন্নাহর নস ও প্রায়োগিক প্রমাণের ভিত্তিতে এর স্পষ্ট বিধান বর্ণিত হয়েছে।
