Implementation of international standards for application of weapons in Ukraine’s legislation
Journal Title: Альманах міжнародного права - Year 2017, Vol 18, Issue
Abstract
The domestic and international legal norms regulating the use of weapons by police are compared. It is revealed that in Ukrainian legislation, most of the norms of the international legislation concerning the use of weapons by the police are fully implemented adequately. A wide range of normative acts that came into force in the area of the use of weapons, convinces that the positive experience of the international community in regulating relations on these issues has become a benchmark for national legislation and provides an opportunity to state that there is a potential basis for ensuring the rule of law in the use of weapons in police activity. At the same time, there are some discrepancies and inconsistencies in the system of these principles, which requires their further research and improvement, since gaps in the law may adversely affect the work of a policeman who performs his functional duties.
