La pena de muerte como factor disuasorio del crimen: Un análisis estadístico

Abstract
This article addresses the controversial issue of the death penalty from a dual perspective: legal and humanitarian. The main objective of this research is to analyze the perceptions and critical evaluations of Ecuadorian society regarding the death penalty as a mechanism of criminal justice. To this end, both arguments in favor and against its implementation are examined, framed in the context of ethical principles and legal regulations. The research is based on an exhaustive review of the literature, including legal sources and national and international academic studies on human rights. In addition, empirical data were collected through surveys and interviews, complemented by a predictive statistical analysis based on linear regression. This quantitative approach allowed us to explore the relationship between the death penalty and the perception of its ability to deter crime. It is important to note that, in Ecuador, the death penalty was abolished in 1906, and its implementation is prohibited by the current Constitution, as well as by international treaties and conventions to which the country is a signatory. Despite this, the debate on its effectiveness as a deterrent measure is still relevant at the global level, which motivates the need for a more in-depth and data-based analysis.
