LEGAL STATUS OF SUBJECTS OF INVESTMENT ACTIVITY

Abstract
The article analyzes the doctrinal definitions of subjects of investment activity. The conducted research testifies to the domination of developments of the economic aspect of the issue over the legal one, which is probably connected with the economic nature of the process of investment activity. Putting this problem on the legal plane will ensure effective legal regulation of this economic category. The article defines the functional purpose of guarantees of the rights and legitimate interests of investors, a system of such guarantees is investigated, gaps of this system and problems of implementing certain guarantees are identified. The state guarantees the protection of investments regardless of the forms of ownership and sources of investment, including foreign investment. All investors (including foreign ones) are guaranteed equal treatment, excluding the use of discriminatory measures that could impede the management of investments, their use and liquidation.
