МІЖНАРОДНО-ПРАВОВЕ ЗОБОВ’ЯЗАННЯ ДЕРЖАВ ЩОДО НЕВИДАЧІ СТОСОВНО ШУКАЧІВ ПРИТУЛКУ

Abstract

The article deals with the problem of non-refoulement of asylum-seekers. While it is a well-established rule of international law that refugees may not be refouled (deported) to a state, where they may be persecuted or where their fundamental rights may be at risk, there is in fact no corresponding rule in relation to the asylum-seekers, who have not yet been granted refugee status. The 1951 Refugee convention does not even contain a strict rule obligating states to consider the applications for asylum. Under legislation of most states, when a person is already present at the State’s territory, an application for asylum must be at the very least considered. However, there is a large group of persons who are factually unable to lodge an asylum application, as they are not yet on the territory of the state where they would like to apply and they are effectively prevented from entering the state territory by border guards or similar state bodies. In Europe, this problem has been resolved in the practice of the European Court of Human Rights, which in a series of judgments (including against Ukraine) concluded that failure of a state to grant a refugee status to asylum-seekers at its border amounts to violation of the non-refoulement principle and fundamental rights under the European Convention. However, this does not stand true for most states, including the USA and the majority of the developing states. This is partially due to the inability of most states to secure the rights and integration of refugees to their societies. The absence of a universal state practice demonstrates that the non-refoulement principle in relation to asylum-seekers has not yet acquired a customary character. Moreover, there is hardly any evidence of the relevant opinio juris. Therefore, if this principle has a chance to be expanded on asylum-seekers, this remains a matter for the future.
