Abstract
The rule of non executing of nonfinal administrative decisions is one of the consequences of a two-tiered administrative procedure in individual cases. A nonfinal decision can be executable, and as a consequence – executed. According to the art. 130 § 3 of the polish Code of Administrative Procedure, the decision is subjected to execution prior the lapse of the term to lodge an appeal. Nevertheless, is the immediate viability of the administrative decision is determinated by entering of this decision into legal transactions as an effect of its service or oral announcement to the party in the proceedings.
