ОСОБЛИВОСТІ ЗАСТОСУВАННЯ ПРАВОВИХ ОБМЕЖЕНЬ В АДМІНІСТРАТИВНОМУ ПРАВІ

Abstract
In this scientific article the content of the concept and essence of legal constraints in administrative law is disclosed. It is determined that the concepts of "legal restrictions" and "restrictions of rights" are related with each other as a species and kind. The author outlines the common and distinctive features of the concept of "legal restrictions" and "restriction of rights". In particular, the common features are: 1) applied by the respective authorized agents; 2) involves infringing (squeezing) the behavior of the subject in the appropriate framework; 3) is applied outside the will of the addressee; 4) the grounds are the provisions of the relevant regulatory legal acts; 5) have an individual character of application. Highlighted by signs of legal constraints. It has been determined that legal restrictions are defined by normative legal acts individual (subjective) and concrete measures of administrative-legal nature, which are applied by means of committing appropriate actions by authorized actors of public administration, which are directed on the coordination of behavior and actions of the subject- the addressee in the appropriate boundaries, the framework, the rules dictated by the nature of its activities, legal status.
