Payment of proceedings costs in Iran law With comparative study in some legal systems

Abstract
Petition is one of the most important judicial documents used for filing a suit. In Iran, petition requires the petitioner first to pay the court costs to the government. As stipulated in the article 54, the Civil Procedure Code of Iran, after chief clerk of the court records the petition, he/she must inform the petitioner or his/her agent of the petition defects and its attachments, and issue the defect elimination notice. The petitioner must, within 10 days, take action to elimination the defects. If, within this term, he/she fails to elimination the defects, the petition will be dismissed as per the writ of rejection of the plaint issued by the chief clerk of the court. One of the defects is non-payment of the court costs. The present study aims at clarifying the dimensions and sanction of this legal responsibility comparatively in Iran, Lebanon, France, and United Kingdom.
