ПОНЯТТЯ ПРАВОЗМІНЮЮЧИХ ЮРИДИЧНИХ ФАКТІВ У ЦИВІЛЬНОМУ ПРАВІ

Abstract
Зміна правовідносин може полягати у зміні суб’єктного складу чи змісту, а в деяких випадках – і зміні в об’єкті правовідносин. Зроблений висновок дозволяє стверджувати, що до правозмінюючих юридичних фактів належать ті, які тягнуть за собою зміну цивільних правовідносин. При цьому зміни можуть відбуватися у будь-якому їх елементі (суб’єктному складі, змісті, об’єкті). Визначення поняття правозмінюючих юридичних фактів вказує на необхідність проведення подальших наукових досліджень із установлення їх місця в системі юридичних фактів, видів та правової сутності, специфіки правових наслідків у різних видах цивільних правовідносин. Це створить можливість перевірити ефективність норм права, які покликані регулювати цивільні відносини, вдосконалити існуючий механізм їх правової регламентації. Ключові слова: правовідносини, юридичні факти, зміна суб’єктивних прав та обов’язків, зміна суб’єктного складу, зміна в об’єкті.
