ПОНЯТТЯ ТА КЛАСИФІКАЦІЯ ВІКУ, З ЯКОГО МОЖЕ НАСТАВАТИ КРИМІНАЛЬНА ВІДПОВІДАЛЬНІСТЬ

Abstract
The article is dedicated to the analysis of the scientific views on the definition of age of the criminal liability. It is specified that there is no definition of "age of criminal liability" in the Criminal Code of Ukraine and the Resolution of the Plenum of the Supreme Court of Ukraine. It is stated that in the scientific literature the age is predominantly defined as the calendar period, which took place from birth to any other chronological period in the human life (wide interpretation), and the calendar period of mental and physical development of the human, which is related to biological, social and psychological, and legal consequences for the legal status of the entity (narrow interpretation). There are considered the classification age groups of the criminal liability.The conclusion has been drawn that while determining the age of the criminal liability you need to be guided by the degree of the psychological development of the person: his/her ability to realize his/her actions, manage and understand their danger.
