PROTECTION OF PERSONAL INFORMATION IN SOCIAL NETWORKS

Abstract

This article analyzes the protection of personal data in a social network. The article considers the protection of personal data of a person as a necessary element of human life in the information society, that is, it is a fundamental human right, and in case of its violation, the security of a person, his honor, dignity and the like are at risk. The article defines that in Ukraine the main legal act regulating relations arising in connection with the protection of personal data in a social network is the Law of Ukraine “On the Protection of Personal Data” dated June 1, 2010. This law regulates legal relations on the protection and processing of personal data, and also aims to protect the fundamental rights and freedoms of a person and citizen, including the right to non-interference in personal life, in connection with the processing of personal data. However, it is worth noting that on May 25, 2018, the General Regulations for the Protection of Data of the European Union dated April 27, 2016 (hereinafter referred to as the GDPR Rules) came into force, which began to regulate relations on the protection of personal data not only in the EU, but partially in Ukraine. The article analyzes the application of the rules of GDPR with specific cases. Among them, special attention is paid to the right to erase, the right to mobility, as well as the right to provide consent for the processing of personal data. The right to data mobility is the right under which the data subject may require the controller to provide his own personal data provided in the process of using the social network in a structured, generally accepted format that is easily read by the machine and the right to transfer such data to another controller without hindrance. from the primary controller. In turn, the right to erase personal data allows the subject of personal data "to be forgotten", that is, to require the erasure of all personal data, in which case the controller must remove this data without any undue delay.
