The article describes and highlights some of the problems connected with the definition and the definition of “official of a business entity” as a special subject of crimes in the sphere of economic activity. Clearly defined legislative discrepancies in the definition of “official of a business entity” as a special subject of crimes in the sphere of economic activity which consists in the fact that the generally accepted definition of “officer” presented in Part 3 of Art. 18 of the Criminal Code corresponds to the definition of a special officer filed a note to Art. 364 of the Criminal Code applicable to official crimes while a separate definition of official business entity in the understanding of economic crimes will be omitted. Also carried out an analysis and a theoretical justification of the possibility of a wide understanding of the concept of “economic entity’ with the qualification of actions of a particular person for action under the provisions of Art. Art. 212 212-1 of the Criminal Code of Ukraine in particular by the officials as a special non-entrepreneurial societies entities stipulated crimes.
