Testamentum holographum

Abstract
Testament holograficzny jest pochodzenia greckiego i oznacza testament spisany własnoręcznie, jedną i tą samą ręką. W tym znaczeniu występuje w tekstach papirologicznych na terenie grecko-rzymskiego Egiptu. W prawie rzymskim pojawia się dopiero w V wieku w ustawie cesarzy Teodozju- sza II i Walentyniana III jako dopuszczalna forma testamentu sporządzonego własnoręcznym pismem – per holografam scripturam, bez udziału świadków. Cesarz Justynian nie zaakceptował jednak tej nowości w swojej kodyfikacji i powrócił do klasycznych form sporządzania testamentu. Pojęcie testamentu holograficznego zachowało się jednak w germańskich spisach prawa (Lex Romana Burgundionum; Lex Romana Visigothorum) i tą drogą przeniknął on do ustawodawstw nowożytnych, pośrednio także do polskiego prawa cywilnego.
