THE LEGAL AND ORGANIZATIONAL BASES FOR THE ACTIVITY OF UKRAINIAN MILITIA TO COUNTER ECONOMIC CRIME AT THE STAGE OF DEVELOPMENT OF AN INDEPENDENT STATE (HISTORICAL AND LEGAL ASPECTS)

Abstract
In the article it is analyzed the causes of the formation, status, trends of the evolution of economic crime and its impact on the development of institutional transformations in the economy and the socio-political sphere in the process of the establishment of Ukraine as an independent State. It is stated that after independence, there had been noted the rapid growth of economic crime, especially the most dangerous manifestations. In the list of new types of economic crime that occurred during transforma-tion in the economy of the state there had been noted the manipulation of materials, raw materials, equip-ment and finished products through existing and fictitiously created by cooperatives, small and joint en-terprises, crimes in the financial-banking sphere. It is researched the formation and development of the legal framework and evolution of organizational and regular police units of Ukraine concerning the combating with economic crime over the 90-ies, the 20th cen-tury. It is pointed out that after the establishment of an independent State there had been created a special-ized police service for combating economic crime – the State service of protecting the economy from crimi-nal encroachments. It was subsequently transformed into the State service for combating economic crime. In the composition of the Ministry of Internal Affairs it was formed SSCEC of MIA of Ukraine and formed its organizational and staffing structure in the regions of the country. There were the main tasks of the service which include timely opposition of economic crimes and their pre-vention; analysis and forecasting of criminogenic processes in economy and timely informing on them to the authorities; detection and prevention of violations of intellectual property rights; identifying the causes and conditions that contribute to the perpetration of offences in the economic sectors, and take measures to eliminate them. It is illustrated the main forms and methods of activity of the State service for combating economic crime on the main directions of counteracting crime in economic sphere of the state. It is summarized and systematized management and organizational experience of activity of MIA of Ukraine aimed at strengthening the effectiveness of the activities of the SSCEC. It is identified the main reasons that prevented the SSCEC units to solve a challenge of effective opposition to criminal violations of the state's economy during the first decades of its formation and development.
