THEORETICAL AND LEGAL BASES OF ADMINISTRATIVE AND LEGAL REGULATION OF THE IMPLEMENTATION OF EXPORT-IMPORT TRANSACTIONS IN UKRAINE

Abstract
As of today, foreign economic activity is becoming one of the most important elements of the Ukrainian economy. The implementation of this activity requires proper legal regulation by the state. At the same time, Ukraine’s integration into the world economic space requires new approaches to scientific support of the application of the current legislation of Ukraine, the procedure for its adaptation to the norms of international law, in particular, the norms and rules of the World Trade Organization and the rights of the European Union. The implementation of foreign economic activity is the subject of legal regulation of many branches of the law of Ukraine. At the same time, taking into account the principle of sovereignty of the people of Ukraine (the independence of Ukraine in the implementation and regulation of foreign economic activity) and the presence of public interest in its results, in our opinion, administrative law is the leading branch of law that regulates this activity. At the same time, the administrative and legal regulation of the implementation of export-import operations as an integral part of foreign economic activity in Ukraine is not sufficiently highlighted in recent studies and publications, therefore the coverage of the theoretical and legal basis of the administrative and legal regulation of the implementation of export-import operations is the purpose of this publication. The article studies the theoretical and legal bases of administrative and legal regulation of the implementation of export-import transactions in Ukraine. The definitions of the main categories are given: “export-import transactions” and “administrative and legal regulation of the implementation of export-import transactions”. The author came to a conclusion about the importance of the administrative and legal regulation of the implementation of export-import transactions. The analysis of recent researches and publications has been carried out. Specifics and a number of proposals aimed at improving the efficiency of administrative and legal regulation of the implementation of export-import transactions in Ukraine are indicated. In general, Ukraine should: 1) implement specific measures aimed at improving the quality of public administration in the field of foreign economic activity; 2) taking into account foreign experience, the adaptation of domestic legislation to the norms of international law, the administrative and judicial mechanisms for their application, should be completed; 3) deepening the cooperation of lawyers and economists; 4) a mechanism for the effective use of legal remedies for the protection of national commodity producers and the development of exports provided for in the rules and regulations of the World Trade Organization and the law of the European Union; 5) codified normative and legal regulations regulating the procedure of export-import transactions in Ukraine etc.
