TOURIST AS THE MAIN PARTICIPANT OF CIVIL LEGAL RELATIONS IN THE SPHERE OF TOURISM

Abstract
The article deals with theoretical study of the concept and definitions of the tourist as the main participant of civil and legal relations in the sphere of tourism. The analysis of international acts and legal literature is being carried out to determine the concept, types and main features that characterize the tourist, from which a substantiated conclusion is drawn that both in domestic and foreign doctrine, legislation, law enforcement practice, there are a number of problems in determining the concept and legal status of the tourist. The peculiarities of the civil law approach to understanding of the tourist as a subject of civil-legal relations are described. It is substantiated that the definition of a tourist through the concept of an individual promotes his understanding from the point of view of civil law and can be used in legislation in order to emphasize his exclusively human nature and primarily the civil-legal nature of relations in the sphere of tourism.
