CONCERNING THE INSTITUTIONAL DEFINITION OF ADMINISTRATIVE AND LEGAL CONSTRAINTS

Abstract
In this scientific article the author analyzes the concepts of the institute of administrative law. The legal positions of scientists concerning the characteristics of a certain legal phenomenon which can be attributed to the institute of law are highlighted. The derivative characteristics of these concepts are determined. The content of the characteristics of administrative and legal constraints, which allows to assert their institutional certainty, is disclosed. The compulsory and optional elements, which give grounds to assert the presence of a separate administrative-legal institute, are singled out.
