ПРАВОРЕАЛІЗАЦІЙНЕ ЗНАЧЕННЯ ПРИНЦИПУ-ПРЕЗУМПЦІЇ ПРАВОМІРНОСТІ РІШЕНЬ ПЛАТНИКА ПОДАТКІВ

Abstract
The article proves that the principle-presumption of the legitimacy of the taxpayer’s decisions plays an important role in tax enforcement. The nature of the presumptions in law is determined: today there are two approaches to understanding the presumption: a) the presumption as a general civil phenomenon; b) presumption as a category of exclusively legal nature. Proponents of the first approach define presumptions as categories of a universal nature, which can be directly applied in various spheres of social interaction. In accordance with the second approach, the presumption is associated with such categories as «legal assumption», «assumption of a legal nature», etc.
