SENTENCING TO A MORE LENIENT PUNISHMENT THAN PROVIDED BY LAW AT AGGRAVATING CIRCUMSTANCES

Abstract
The article is devoted to problems appointments of punishment than provided by law. We study theoretical approaches to the application of less ever penalties in the presence of aggravating circumstances. It is proved that the establishment of these circumstances does not preclude the application of Art. 69 of the Criminal Code of Ukraine.
