ACTUAL ISSUES OF LEGISLATIVE DEFINITION OF SPECIAL FORFEITURE AND ITS SUBJECTS WITHIN THE CURRENT CRIMINAL CODE OF UKRAINE

Abstract
The article deals with prerequisites for the background of special forfeiture in the criminal law of Ukraine, as well as defines the key issues on legal regulation of the special forfeiture and its subjects. It has been concluded as follows: first, the special forfeiture, enshrined in the Criminal Code of Ukraine, is the actual legislator’s attempt to introduce the property forfeiture outside of the criminal proceedings; secondly, the criminal law on the legality for possession of the property by third parties and the identification of subjects of forfeiture requires its improvement.
