TEMPORARY RESTRICTION ON THE USE OF SPECIAL LAW IN THE CONTEXT OF APPLICATION OF CRIMINAL PROVISION FOR MEASURES

Abstract
The article is devoted to the review of the issue of the application of a temporary restriction on the use of special law as a special measure for the provision of criminal proceedings, in particular regarding the removal of documents certifying the right to engage in entrepreneurial activity. In this context, the author conducts a detailed analysis of judicial practice regarding the application of a temporary restriction on the use of special law. In addition, the author raises the question of determining the scope and characteristics of documents to be withdrawn in response to a petition by an investigating judge on the application of a temporary restriction on the use of special law, namely, the right to engage in entrepreneurial activity.
